12 COMES NOW the Defendant, ELIO VOLPENTESTA, by and through his
13 attomey undersigned, and hereby moves this Court for an Order releasing Defendant’s passport
14 from the Clerk of Court which was surrendered to them on May 21st, 2002 by Order of
15 MAGISTRATE JUDGE DAVID K. DUNCAN. It is also respectfully requested that notice be
16 given to OFFICE OF PASSPORT POLICY AND ADVISORY SERVICES in Washington,
17 D.C. Defendant was released from Probation on January 14th, 2005 by RHONDA L. SPENCER,
18 U.S. Probation Officer and an Order Of The Court discharging Defendant from Probation and that
19 the proceedings in the case be terminated was signed by the HONORABLE JAMES A.
20 TEILBORG, United States District Judge.
