The defendant by and through his undersigned attorney respectfully moves the court

for a continuance of the violation hearing set for January 14, 2008. The defendant has this
16

date filed a motion to continue the sentencing in CR07-837-PHX-FJM which is also set for
17

January 14, 2008. The reason for the sentencing continuance is to give the defendant time
18

to file objections to the presentence report. The government has no objections to the
19

continuance.

The defendant would request a 60 day continuance.

It is expected that excludable delay under Title 18, U.S.C. Section 3161(h)(1)(F) may
22

occur as a result of this motion or from an order based thereon.
