On April 18, 2006, a Warrant of Arrest was issued in the above matter. On February 27, 2007, an indictment issued in matter CR 07-212, charging this same defendant with a violation of Title 8, United States Code, section 1326(a). On that same day, the government filed a Notice of Related Cases. On February 28, 2007, CR 07-212 was assigned to this Court. On April 20, 2007, after receiving information that the defendant was not apprehended in the District of Arizona, the government filed an unopposed Motion to Dismiss and Vacate Trial Date in CR 07-212 . On April 26, 2007, this Court dismissed the indictment in CR -7-212. Notwithstanding the remaining matter before this court, (CR 00-962), sometime between April 26 and April 30, 2007, the defendant was transferred into the custody of Immigration and Customs Enforcement and was removed from the United States. In that the defendant failed to appear for a hearing on May 7, 2007 in CR 00-962, the government motions the Court to issue a Warrant of Arrest to be served on the defendant in the United States of America, CR-00-962-PHX-DGC Plaintiff, v.
