16 Defendant wrote a letter (a copy attached) to the
17 Court referencing his inability to receive credit on his
18 Sentence after completing the BOP residential drug abuse
19 program (RDAP).
20 On September 9, 2005, the Court wrote to his case
21 manager recommending that when "eligible he be allowed
22 to participate in that program." A copy of this letter
23 is attached.
24 Defendant wrote the Court under date September 19,
25 2005 (copy attached) concerning the circumstances why he
26 is not eligible for that credit, ie., he had a two level
27 enhancement (PSR #34) at sentencing for "possession of a
28

1 firearm in connection with the offense." The Plea
2 Agreement and factual basis did not refer to a firearm.
3 The purpose of this Order is to call the
4 Government's attention to Defendant's request for
5 consideration and for any response it deems appropriate.
6 The possibility of a state detainer may be a relevant
7 circumstance as well.
8 Accordingly,
9 IT IS ORDERED, referring Defendant's request to the
10 Government for its consideration;
H IT IS FURTHER ORDERED that the Clerk update the
12 docket be updated to include Defendant's address:
