Dear Merrick and Veronica: A
In response to the statements in Nelcela’s Motion in Limine No. l, that you have not
received what you called "pure text files" used by Mr. Zeidman in his analysis, enclosed please
find a CD containing the text files exported by PowerBuilder from the Nelcela source code {
which were used by Mr. Zeidman in his analysis. You have always had access to these files as g
they come directly from your clients’ source code. But evidently you know that, as shown by §
your questioning of Mr. Zeidman during his deposition. (See Dep. of R. Zeidman at 56:1-8.) g
Also, enclosed is a list of additional trial exhibits, which include the accompanying CD
along with printouts of some of the files on that CD. The only other new exhibits are the exhibits
to the Lexcel complaint, which for some reason appear to have been omitted from Exhibit 290
(the Lexcel Complaint). Please let us know of the Nelcela Parties’ objections, if any, to these A
exhibits, and we will then file the list with the Court. Z
