17 On January 19, 2007, Nelcela, Inc., Len Campagna and Alec Dollarhide ("Nelcela") filed a
18 Motion in Limine to exclude the expert testimony and "Codel\/latchTM" results produced by expert
19 Robert Zeidman. As part of that motion, Nelcela informed the Court that Mr. Zeidman failed to ever y
20 produce the "pure text files" that he claimed to have used in his reporting and in his testimony. r
2] (These "pure text files" are what Mr. Zeidman testified that he purportedly extracted from the
22 various codes to remove common factors, Le., commas, return carriages, “slashes," or commonly-
23 used programming language, so that he compared only the "pure text" of each software produced.)
24 Today, January 29, 2007, undersigned counsel just received a letter from Mr. Richard Halloran,
25 Post’s counsel, along with a CD of the purported "pure text files" that were requested a vear ago.

1 Contrary to Post’s assertion that Nelcela, "had access to these files," that is simply untrue. J
2 The "pure text files" are the portion of code that Mr. Zeidman reported to have fettered out of
3 various codes when detecting similarities. Only Mr. Zeidman had these, "pure text tiles," and only 7
4I Mr. Zeidman and/or Post’s counsel could have provided them. They were withheld until now.
5 Exhibit A provides proof to this Court that Post withheld information that Nelcela requested, I
6 and this information was essential to evaluate the veracity of Mr. Zeidman°s report and testimony.
7 Exhibit A is supplemental proof to support that Mr. Zeid1nan’s testimony and results should be ,
8 inadmissible at trial.
