2 2. PRIOR PROCEEDINGS
3 On October I2, 2006, the Court filed an order denying the
4 Defendant’s (‘°Sears") Motion for Summary Judgment (to compel
5 arbitration_). Dkt. #4}. On October 23, 2006, Sears filed a Motion for
° Reconsideration pursuant to L R Civ. 7.2(g). Dkt. # 44. On October 24,
i 2006, the Court issued an Order directing Batory to file a response tothe
** Motion for Reconsideration within fifteen days from that date (by
" November 8, 2006). Dkt. # 45.

" 3. REASONS FOR REQ QUESTED EXTENSION
'2 The undersigned is a seventy-five year old semi-retired sole
li practitioner, with only a part-time secretary.
M Because the undersigned believes that the Motion for Reconsideration
*5 mis-states both the record before the Court and the law, it is taking longer
I6 than anticipated to finish researching and drafting Batory’s response,
I? particularly with the deadlines in other cases that I must meet.
