This case was recently reassigned to a new judge who requires sufficient information to provide an appropriate scheduling order for the prompt resolution of this aging litigation. Counsel are directed to confer and then no later than November 30, 2006, file a joint status report which suggests a proposed schedule for the expeditious pre-trial development of this case. The report should include the following: (1) date upon which the parties provided or will provide their initial disclosure required by Fed. R. Civ. P. 26; (2) date upon which the parties will exchange expert witness reports, or a statement that experts will not be used; (3) date for the close of discovery; (4) indication of when supplements to discovery will be made (e.g., at 60-day intervals); (5) whether there is any need to amend the pleadings, and if so, a deadline for amendments; (6) deadline for filing discovery motions; (7) deadline for filing dispositve motions; (8) whether all parties consent to having further proceedings, including trial, conducted by a magistrate judge; (9) whether a timely demand for jury trial was made, and if there is a dispute about the right to jury trial in this case; (10) estimated number of days required for trial; and (11) the prospects for settlement.
