21 Pursuant to Fed.R.Civ.P. l6(b), Defendants hereby request that the Court conduct an
22 expedited, telephonic scheduling conference among Plaintiff, counsel for Defendants, and the
23 Court to discuss the disposition of Defendants’ pending dispositive Motions for Partial Summary
24 Judgment Re Counts One and Two of Plaintiffs Third Amended Complaint ("Motions"), and
25 rescheduling the trial on dates that are mutually convenient to the Court, the parties and
26 Defendants’ counsel.

l Defendants’ Motions were tiled on February ll, 2005, almost a year ago, and were
2 argued to this Court on December 22, 2005, almost six weeks ago. The trial of this case is
3 currently scheduled to commence on Tuesday, February 7, 2006, and to continue until completed
4 on February 8, 9, 14-16, and if necessary 21-23, 2006. Because ofthe pending Motions, the pre-
5 trial conference which had been set for January 18, 2006 was not held. Further, Magistrate
6 Judge Papas recently scheduled the continuation of the settlement conference for February 14,
7 2006, ten days after the trial is currently scheduled to commence. Because of the inherent
8 uncertainty with respect to the issues raised in Defendants’ Motions and the lack of a pretrial
9 conference order, it is difficult, if not impossible, to schedule witnesses for trial.
10 Because the Motions could dispose of all or major aspects of the remaining claims in this
11 case, and because of the cancellation of the pre-trial conference and the current schedule for
12 commencement of trial in four business days from today, the parties need the Court’s guidance
13 concerning the likely timing of the Court’s ruling on Defendants’ Motions and rescheduling the
14 pre-trial conference and the trial.
15 For the foregoing reasons, justice requires that the Court set an expedited, telephonic
16 conference for the purpose of discussing disposition of Defendants’ pending motions and
17 rescheduling the pretrial at a time convenient for the Court, the parties, and Defendants’ counsel.
