4 1. I am one of the attorneys representing the CHR Defendants in the matter of
5 Miklcelsen, etal. v. Correctional Health Resources, Inc., etal.
6 2. Until August 27, 2004, CHR Defendants did not know the timing or I
7 mechanism of Kelly Mikkelsen’s ingestion of a lethal dose of Darvon. i
8 3. On August 27, 2004, Joseph Nimmo was deposed; and on September 16, Q
9 2004, his son, Jeremy Nimmo was deposed, as a follow up to information learned during
10 Joseph Nimmo’s deposition. Z
ll 4. At the August 27, 2004 deposition of Joseph Nimmo, I learned for the first
12 time that Kelly Mikkelsen ingested the fatal dose of Darvon on the afternoon of his death; at
13 the September 16, 2004 deposition of Jeremy Nimmo, I learned of the large quantities of _:
14 two different kinds of pills taken by Kelly Mikkelsen between 5:00 p.m. and 6:00 p.m. on i
15 October 1 1, 2001. i
16 5. Prior to that time, CHR Defendants had only been given information that
17 Kelly Mikkelsen had taken drugs sometime that morning or at a minimum, several hours
18 before returning to the detention center.
19 6. CHR has always offered to allow Plaintiffs to redepose Dr. Gottula at CHR’s
20 expense.
