On May 26, 2006, the Court issued a Memorandum of Decision and Order granting Plaintiff until June 26, 2006 to notify the Court whether he would elect to accept the suggested remittitur or proceed to a new trial on the issue of damages. In light of certain factual and legal oversights in the May 26, 2006 Order, Plaintiff has filed a Motion for Reconsideration re Remittitur of Punitive Damages Award. Plaintiff asks for expedited consideration of his Motion for Reconsideration because the Court's decision on that Motion will affect whether Plaintiff accepts or rejects a remittitur or proceeds to a new trial. To allow Plaintiff sufficient time to consider his options, Plaintiff asks that the time to notify the Court whether Plaintiff elects to accept the remittitur be extended to 10 days after the Court issues its ruling on the pending Motion for Reconsideration.
