Pursuant to 35 U.S.C. § 285, and Local Rule 54.2(b)(1) Eberle Design, Inc. and Electronic Devices, Inc. (collectively, "Eberle") hereby file their Motion for Recovery of Attorneys' Fees and Related Non-Taxable Expenses This case was tried to a jury beginning on August 30, 2005. On September 12, the jury returned a verdict in favor of Eberle, finding that the claims of the `964 Patent are invalid under 35 USC § 102(b) because Reno violated the on-sale bar. On November 1, 2005 Judgment was entered. Reasonable attorneys' fees may be awarded to the prevailing party in "exceptional cases." 35 U.S.C. § 285 (2000). Such an award is within the informed discretion of the trial court. Del Mar Avionics, Inc. v. Quinton Instrument Co., 836 F.2d 1320, 1329 (Fed. Cir. 1987). The statutory purpose of this award is to reach cases where the interest of justice warrants fee-shifting. Brooktree Corp. v. Micro Devices, Inc., 977 F.2d 1555, 1582 (Fed. Cir. 1992).

Eberle believes that a fair estimate of the amount of attorneys' fees that will be requested is in the range of about $1,300,000.00 and that a fair estimate of the related nontaxable expenses that will be requested is in the range of about $60,000.00. As set forth in Local Rule 54.2(b)(1), this Motion specifies the applicable judgment and the statutory authority entitling Eberle to the requested award, as well as a fair estimate of the amount. Eberle intends to file a Motion asking the Court to bifurcate consideration of the reasonableness of the requested award from the issues of eligibility and entitlement, which Motion will ask the Court to set a briefing schedule for the bifurcated issues. Eberle intends to file a Memorandum in Support of this Motion within the time set forth in LRCiv 54.2(b)(3) or, if the Motion to Bifurcate is granted, pursuant to the briefing schedule entered pursuant to that Motion.
