Eberle Design, Inc. and Electronic Devices, Inc. (collectively, "Eberle") hereby file their Motion to Amend September 27, 2005 Order Denying Eberle's Motion for Judgment as a Matter of Law. In this Court's Order dated September 27, 2005 ( Doc. # 216, a copy of which is attached hereto as Exhibit A), Item No. 3 denies Eberle's Motion for Judgment as a Matter of Law in its entirety. However, the trial transcript for the afternoon of September 8, 2005 reflects that the Court granted Eberle's Motion for Judgment as a Matter of Law as to Claim 34. Attached hereto as Exhibit B are copies of the pages of the trial transcript reflecting that ruling. Accordingly, Eberle moves the Court to amend the Order denying their Motion for Judgment as a Matter of Law to reflect that the Motion was granted as to Claim 34 and denied in all other respects.
