The Court has received Eberle's Motion to Amend September 27, 2005 Order Denying Eberle's Motion for Judgment as a Matter of Law (Doc. #217). The motion is well taken. The Court's Order dated September 27, 2005 (Doc. #216) is amended to provide that Eberle's Motion for Judgment as a Matter of Law (Doc. #213) was granted with respect to claim 34 and denied in all other respects.
