Appellant Rachel McElninney’s motion to consolidate appeal Nos.
06-10438, 06-10446, 06-10447, 06-10448, and 06-10462 is granted in part.
Appeal Nos. 06-10438, 06-10447, and 06-10448 are consolidated. I
Appellant McElninney’s motion for an additional extension of time to file
the opening brief is granted in part. The court notes that appeal Nos. 06-10438, 06-
10447, and 06-10448 have been expedited by the court in view of the brevity of the
i sentences being served by appellants Priest, Ensign, and McElhinney. The
following expedited briefing schedule shall govern the consolidated cases. The .
opening briefs will be due January 26, 2007. The answering brief will be due
February 26, 2007. The optional reply briefs are due 14 days after service ofthe
answering brief The appellants are reminded of the court’s preference for joint

on the court’s April 2007 calendar. No telephonic extensions of time to tile briefs
will be granted pursuant to Ninth Circuit Rule 31-2.2(a).. Written motions for
extensions of time arenstrongly discouraged and will not be granted absent a R
showing of extraordinary circumstances. ·
In view of the court’s expedition of these cases, motions for extensions of ‘
time to file transcripts in appeal Nos. 06-10438, 06-10447, and 06-10448 are
. discotnaged. A copy of this order will be provided to Court Reporter Supervisor
Deborah Lucas at the district court.
The existing briefing schedules for case Nos. 06-10446 and 06-10462 remain
in effect. -
