18 Pursuant to Rule 46(t)(3), Federal Rules of Criminal Procedure, the United States
19
20 moves for a hearing regarding entry of judgment against Defendant Keith D. Priest and the
2] obligors on the bail bond.
22 Pursuant to Rule 46(t)(1), the Court declared forfeited the bail bond on September 29,
23
2006, (Dkt. 1028) due to the default caused by Defendant Keith D. Priest’s failure to comply
24
25 with the terms and conditions of release. The obligor on the bond is Jack M. Priest. The
26 obligation under the bond has not been paid by the defendant or the obligor.

1 Plaintiff requests the court to set a date for a hearing, at least thirty (30) days from the
2 date of this filing, in order to give the obligor an opportunity to be heard. All persons
3
4 potentially liable on a surety bond are entitled to notice and an opportunity to be heard during
5 judicial proceedings that may affect their interests. See, United States v. King, 349 F.3d 964,
6 966—67 (7* Cir. 2004). At the hearing the Plaintiff will ask the Court to enter final judgment
7
8 declaring the defendant and the obligor liable to the United States for $30,000 according to
9 the terms of the bond plus costs and interest, and to declare the entire amount forfeited to the
10 United States.

By this filing, Plaintiff is sewing notice of this motion on the obligor, Jack M. Priest,

13 and on defendant Keith D. Priest’s attorneys of record, Gregory T. Parzych (trial attorney) ‘
14 and Philip Hantel (appellate attorney).

_ Plaintiff further requests that, pursuant to Rule 46(f)(3), if no claims are made by the

17 obligor or defendant challenging the governrnent’s motion for entry of judgment on bail bond
18 forfeiture and a default judgment is entered, the proposed Order, if issued by the Court,
lg promptly be mailed, by the district clerk, to the surety, Jack M. Priest, at his last known

21 address of 6306 Shenandoah Place, Stockton, Califomia, 95219. A proposed Order of
