COMES NOW the defendant Keith D. Priest, and provides Notice of two Potential Conflicts with the new sentencing dates set by this Court on June 9, 2006. A Sentencing Hearing is now set for June 27, 2006 at 9:30 a.m. and Sentencing is set June 28, 2006 at 9:30 a.m. Counsel provides Notice that he currently has a Sentencing set on June 27, 2006, at 9:00 a.m before the Honorable Stephen M. McNamee in United States of America vs. Terry Wayne King, CR 04-488-PHX-SMM. Counsel believes that the King sentencing should be complete by 9:30 a.m. Counsel further provides Notice that he has non-refundable plane tickets purchased before June 9, 2006, in which counsel will be flying to Wisconsin on June 30, 2006, for a family vacation. Counsel will be in Wisconsin until July 6, 2006. Counsel is currently available for the dates the Court has set. However, if the Sentencing Hearing is not completed by June 30, 2006, counsel will have a scheduling conflict. Respectfully submitted this 12 day of June, 2006.
