FOR THE GOVERNMENT: Thomas Klepper is sworn and examined. THE COURT FINDS that the acquitted conduct is relevant for Sentencing as to Defendants Ensign, Priest, and McElhinney. Therefore, the objections with respect to acquitted conduct made by the defendants are overruled.

The Court DIRECTS defense counsel to resubmit their objections and file any new objections in light of any new information set forth in the final presentence report by close of business on May 2, 2006. The Court FURTHER DIRECTS defense counsel to file final sentencing memorandums by close of business on May 9, 2006. Government shall file a response to the objections and final sentencing memorandums by close of business on May 16, 2006. IT IS ORDERED continuing the Pre-Sentence Hearing to Tuesday, June 6, 2006 at 9:30 a.m. Sentencing as to each defendant will occur on Wednesday, June 7, 2006 beginning at 9:30 a.m. in the following order: Priest, McElhinney, Ensign, Trepas, and Poseley.
