I. Introduction.

Defendant Century Surety Co. (“Centu1y”) moves this Court for an award of
19
attorneys’ fees and nontaxable expenses incurred to defend against the complaint and
20
purported counterclaim filed against it by plaintiff Century 21 Real Estate LLC ("C21"). In
21 total C21 alleged ten causes of action against Century related to claimed service mark
22 infringement, dilution and unfair competition arising under the Lanham Act, 15 U.S.C.
23 1051, et req., Arizona state law and common law.
24 II. judgment and Statutory Authority.
25 In two orders dated March 16, 2006 (Dkt. 177), and February 9, 2007 (Dkt. 242),
26 respectively, this Court granted summary judgment to Century on all of C21’s counts. The
27 Clerk of die Court entered nnal judgment for Century on February 9, 2007. (Dkt. 243). As
28 the prevailing party in this case, Century is entitled to its attorneys? fees pursuant to the

l Lanham Act, 15 U.S.C. § 1117 since this is an exceptional case, and its nontaxable costs
2 pursuant to Fed. R. Civ. P. 54(b).
3 III. Estimate of Fees and Fed. R. Civ. P. 54(b) Expenses Sought.
4 Century seeks (a) $1,249,124.25, a fair estimate of the attorneys’ fees it has incurred to
5 date, plus $75,946.00, a fair estimate of the nontaxable costs it has incurred to date, plus
6 (c) the fees and costs related to this Motion and any supporting memoranda.
7 IV. Memorandum and Supporting Documentation.
8 Pursuant to Local Rule 54.2{b)(1}—(2), if the parties are unable to resolve the
9 attorneys’ fees and nontaxable cost issues, Century will file a memorandum of points and
10 authorities and documentation supporting this motion no later than 60 days from the entry
