Pending before the Court is Defendant ValueOptions' Motion to Strike Affidavit of John M. Scales (Doc. # 231). Defendant ValueOptions requests that the Court strike the affidavit of John Scales because it is hearsay, irrelevant, and advancing opinions reserved for experts. Without passing judgment on the admissibility of Plaintiff's proffered affidavit, the Court will deny Defendant ValueOptions' Motion to Strike. As Defendant ValueOptions acknowledges, it has already articulated specific authority to support its objections. When deciding the pending cross motions for summary judgment the Court will be able to determine what is admissible evidence and what is not. Accordingly, /// /// ///
