16 Pursuant to the court’s Amended Rule 16 Scheduling Order of January 24,
17 2005, the parties hereby propose the following Statement of the Case:
18 STATEMENT OF THE CASE
19 Plaintiff" s home was damaged by fire on March 19, 2001. As a result,
20 Plaintiff filed an insurance claim with his insurer, State Farm Fire and Casualty Company.
21 Plaintiff claims that State Farm breached the insurance contract in refusing to pay portions
22 of his claims concerning loss of use and the costs required to replace or repair the
23 resulting damages to his home and its contents. Plaintiff further claims that State Farm
24 denied portions of his claims either knowing of, or with reckless disregard of, the absence
25 of any reasonable basis for not paying those claims.
26 State Farm denies Plaintiff s claims, and alleges that it fulfilled all of its

1 obligations nnder the insurance policy. State Farm further claims that it had a reasonable
2 basis to deny all portions of Plaintiffs claims which were not paid.
