Dear Judge Silver: This is to report on the status of discovery and settlement discussions. The parties have differing views concerning their respective compliance with the Court's scheduling order in this matter. The parties recognize that the issues will require further discussion among counsel and perhaps motions permitting further discovery. Nonetheless, the parties are close to an agreement to attend a mediation in an effort to effectuate settlement in this matter. The mediation will include the defendants in a companion civil case styled Simms v McDougall, Maricopa County Superior Court Cause No. CV2003005205.
