IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA Beth D'Aguanno and Frankie Tyree, plaintiffs, vs. American Builders & Contractors Supply Co., Inc., doing business as ABC Supply Company, Inc., defendant. Pursuant to Local Rule of Practice 1.1(b), Plaintiffs hereby notify the Court and opposing counsel of a trial conflict involving their legal counsel, Stephen G. Montoya, who has personal responsibility for trying this case. On November 2, 2005, this Court set this case for a jury trial commencing on January 23, 2006. However, on August 1, 2005, the Honorable Barry C. Schneider of the Maricopa County Superior Court scheduled a firm trial date in Efrain Morales, et al., v. Univision Television Group, Inc., et al., No. CV 2002-017904, commencing on January 25, 2006, and scheduled to last eight days. Mr. Montoya is co-counsel with his law partner, Augustine Jimenez III, for the Plaintiffs in this action. Mr. Montoya's next available trial date is February 13, 2006.
