Nevertheless, as our Rule 16 scheduling order made 19 clear, discovery problems do not constitute good cause to upset a firm trial date. Indeed, a 20 review of the docket indicates that there was no activity after the entry of our Rule 16 21 scheduling order on March 30, 2004. The parties have had one and a half years since the 22 entry of that order to get their work done.
