19 The parties, by and through counsel undersigned, hereby stipulate and agree to
20 continue the trial, which is cuxxcmcly set for September 13, 2005, and corresponding
21 deadlines for ninety (90) days. This continuance is requested to afford the parties with
22 additional time to complete discovery that is tneeeeeary for e fair hearisng on the merits and
23 aliow justice to prevail. Accordingly, the parties request that the trial and corresponding

l I BASIS FOR CONTHWUANCE.
2 This case arises from :1 Exe a; houseboat, the M/V Canyon Dreamer, and
3 Plaintiffs subsequent removal efforts. Pleintiffoontonds tl1atNationu1Pa:k Service directs,
4 controls and supervises Plaintiff s exclusive operation of all facilities and marinas on Lake
5 Powell in both Arizona and Utah, pursmmt to a. concession contract with the United States.
6 On August 9, 2002, a Exo occurred on the M/V Canyon Dreamer, while it was mooxod to
7 a beachlaead in the Escalante AID.1 of Lake Powell. As directed by the National Park
8 Service to remove the houseboat casmalty from its current location, Plaintiff attempted to
§ 9 tow the houscsboat casualty to Bullféog Marina. After towing the houseboat casualty for
gy .1, 10 apprmdmately twenty (20) miles, the right pontoon failed and the housebout was out loose
3 S 11 and szmkl 'I'he:eafter, Defonilaots contend that the National Park Service ordered that the
§ 12 housoboat be removed. Defendants also contend that the houseboat could not bo found.

17 To date, the paxtios have moved toward moving this ease for trial. However,
13 additional discovery is necessary to allow a fair hearing on the merits. In this regard, there
19 axe several deposition that are necessary. However, many of ihe depositions require
20 siguiiicam: travel, The deposition ofaa Axasruarkxeprescutative, which is set for September
21 7, 2005, will take place in Page, Arizona. In addition, the deposition of a Nacional Park
22 Service witness Brian Sacia is set pursurmt to a Touhy authoxizadou to be deposed in
23 Mamouth Cave, Kentucky on September 1, 2005. Nou·p31Ty witnesses Dermis Forbes has
24 been subpoemed for a cleposition in September, which will take place in Page, AZ.
25 Fwrtlwer, mowparty wituoss Jolm Crawford will only be available to be deposed ¤&e1· his
26 retum from the Aleutians ix: early October, 2005. A Maxkel vvitness from Wisconsin needs
