Legal Services Agreement
Dear i\/ir. Collins:
This vviii confirm the agreement of O'Donoghue & O’Donoghue LLP to serve
as counsel to defen-d PAC Tucson in the above·referenced lawsuit. We vvill also be
serving as counsel to UA Locai 469, UA Local 741 and the individual Trustees
named as defendants in this case, provided that the fiduciary carrier approves of
our retention by those individual defendants. if at any time we believe that
representation of other defendants poses a potential conflict of interest, vve will
discuss such issues with all concerned and arrive at a resoiution satisfactory to all
parties.
Our fees for this vvork will be billed at the rate of $495.00 per hour. lt is
anticipated that most of the legai services wifi be provided by me and John
l\/iclntire, another partner in the firm with extensive empioyee benefits litigation
experience. We vvill also bil-l for travel costs, overnight mail, ion-g distance
telephone calls, copying and other direct expenses incurred in the course of our
representation. As in afi cases, vve vvili do our utmost to perform our services
thoroughly but efficiently. y
