Legai Services Agreement
Dear Ray:
This will confirm. the agreement of O’Donoghue & O'Donoghue LLP to serve
as counsel to defend Local 743 in the abovereferenced iawsuit. We will aiso be
serving as counsel to UA Local 469, PAC Tucson, and the individual Trustees
named as defendants in this case, provided that the fiduciary carrier approves of
our retention by those individual defendants. it at any time we believe that
representation ot other defendants poses a potential conflict ot interest, we will
discuss such issues with all concern-ed and arrive at a resolution satisfactory to all
parties.
Our fees for this work will be billed at the rate of $l95.00 per hour. lt is
anticipated that most of the iegal services will be provided by me and John
Nlclntire, another partner in the firm with extensive employee benefits litigation
experience. We will also bill tor travei costs, overnight rnail, long distance
telephone calls, copying and other direct expenses incurred in the course of our
representation. As in all cases, we will do our utmost to perform our services
thoroughly but efticientiy. §
