Legal Services Agreement
Dear Dave:
This will confirm the agreement of 0'Donoghue & O’Donoghue LLP to serve
as counsel to defend Local 469 in the above-referenced lawsuit. We will also be
serving as counsel to UA Local 741, PAC Tucson, and the individual Trustees
named as defendants in this case, provided that the fiduciary carrier approves of
our retention by those individual defendants. If at any time we believe that
representation of other defendants poses a potential confiict of interest, we will
discuss such issues with all. concerned and arrive at a resolution satisfactory to ali
parties.
Our fees for this work will be biiled at the rate of $195.00 per hour. lt is
anticipated th-at most of the legal services will be provided by me and John
l\/lclntire, another partner in the firm with extensive empioyee benefits iitigation y
experience. We will al-so biil for travel costs, overnight mail, long distance 5
telephone calls, copying and other direct expenses incurred in the course of our Q
representation. As in all cases, we wiil do our utmost to perform our services g
thoroughly but efficiently.
