The Court has presently scheduled for Monday, September 25, 2006 at 3:00 P.M. the continuation of the contempt hearing for Defendant Ronald Holt. Counsel for Defendant Ronald Holt , the Securities and Exchange Commission, the Commodity Futures Trading Commission and the Court's Receiver have been in negotiations regarding a resolution of these contempt proceedings which may make

further hearings unnecessary. Although, the parties had hoped to conclude these negotiations before Monday's hearing, they have been unable to do so. Accordingly, the Receiver respectfully requests a continuance of the hearing set for Monday, September 25, 2006 for approximately 30 days. Counsel for the Securities and Exchange Commission, the Commodity Futures Trading Commission and Defendant Holt have each indicated that they agree to the continuance sought herein. Since this contempt proceeding is also before the Court in CFTC v. International Funding Association, et al, cause number CV-03-1826-PHX-PGR, a similar motion to continue has been filed that action.
