An evidentiary hearing is now set on Tuesday, January 9, 2007, at 3:00 P.M. regarding Petition No. 24, to consider the issues of releasing the 84th Street Property from the receivership, removing the Notice of Lis Pendens, and approving a substitute trustee for the East Maricopa Holding Trust. Pursuant to AZDC LOCAL CIV. R. 7.2(h) Plaintiff, Securities and Exchange Commission ("Commission") respectfully requests to be allowed to attend the hearing by telephone. If any other party requests permission to attend the hearing by telephone the Commission will take responsibility for arranging with all parties a conference call to the Court.
