ORDER

The Court having considered the Motion to Set Aside Order (Doc. 316), filed by Respondent Barry T. Jordan, requesting that this Court set aside its Order dated October 2, 2006 (Doc. 312), that granted the relief requested in Petition No. 24. Therefore, IT IS ORDERED granting Respondent's Motion to Set Aside Order (316). Accordingly, the Order dated October 2, 2006 (Doc. 312), that granted the relief requested in Petition No. 24, is hereby set aside and otherwise vacated. IT IS FURTHER ORDERED that a evidentiary hearing is now set regarding Petition No. 24, to consider the issues of releasing the 84th Street Property from the receivorship, removing the Notice of Lis Pendens, and approving a substitute trustee for the East Maricopa Holding Trust. Such evidentiary hearing will be held on Tuesday, January 9, 2007, at 3:00 pm, in Courtroom 601 before the Honorable Paul G. Rosenblatt.
