Respondent Barry T. Jordan, through his counsel undersigned, files this Reply in support of his Motion to Set Aside Order filed on October 12, 2006. Respondent moved the Court to set aside its Order dated 10/02/2006 (Docket # 312) which granted the relief requested in Petition No. 24 in the above captioned action. Counsel discussed the Motion to

Set Aside, and counsel for the Receiver had no objection to the Motion, or to the Court granting the Motion and setting aside the previous Order. Neither the Receiver nor any other party has filed or served any Response to the Motion to Set Aside. The Court may therefore summarily grant the Motion pursuant to Rule 7.2(i), LRCiv. WHEREFORE, Respondent Barry T. Jordan respectfully requests that the Court grant the Motion to Set Aside, and enter an Order setting aside the previous Order dated 10/02/2006 (Docket # 312).
