REGARDING PETITION NO. 24 PETITION FOR INSTRUCTIONS REGARDING PROPERTY LOCATED AT 10620 NORTH 84TH STREET, SCOTTSDALE, ARIZONA

Respondent Barry T. Jordan, through his counsel undersigned, moves the Court to set aside its Order dated 10/02/2006 (Docket # 312) which granted the relief requested in Petition No. 24 in the above captioned action. This Motion is supported by the following Memorandum of Points and Authorities.

MEMORANDUM OF POINTS AND AUTHORITIES This Motion to Set Aside is filed concurrently with Respondent Barry T. Jordan's Response to Petition No. 24 and Motion to Release Property. Respondent Jordan is the owner of the beneficial interest in the 84th Street Property which is the subject of Petition No. 24, and is residing at said property. Respondent's counsel had been in contact with the Receiver's counsel regarding the response to Petition No. 24. On September 25, 2006, Receiver's counsel granted an extension for the filing of a response. On September 26, 2006 Receiver's counsel sent a copy of Petition No. 24, the Order Re: Petition No. 2, and an Acceptance of Service. Respondent's counsel executed and returned the Acceptance of Service on September 28, 2006. Counsel for these parties had discussed but not yet filed a stipulation regarding the extension of time under Rule 7.3, Local Rules of Civil Procedure, when this Court's Order granting the relief requested in Petition No. 24 was entered. Counsel have discussed the instant Motion, and counsel for the Receiver has no objection to the Motion, or to the Court granting the Motion and setting aside the previous Order. WHEREFORE, Respondent Barry T. Jordan respectfully requests that the Court grant the Motion to Set Aside, and enter an Order setting aside the previous Order dated 10/02/2006 (Docket # 312).
