19 Defendants, Joseph M. Arpaio and Captain Ronnie Tate, by and through
20 undersigned counsel, respectfully request the Court to extend the February 10,
21 2006 deadline until April 21, 2006 to depose Plaintiff, Alvin LaRue Pinkoson.
22 Pursuant to the Court’s Scheduling Order dated November 9, 2005, the deadline

1 to conduct Plaintiffs deposition was February 10, 2006. Defendants were not
2 able to schedule Plaintiff’s deposition prior to this date and Defendants believe it
3 is necessary for Plaintiffs deposition to be taken to determine exactly what his
4 claims are and the extent of any damages. Plaintiff has asserted suffering
5 "serious mental, emotional and physical suffering, psychological stress, and
6 injuries from a physical assault." (See Complaint p.4 1] 4.) As such, Defendants
7 would like to depose Plaintiff for additional detailed information relating to these
8 claims.
9 This is the first continuance requested by Defendants and is not made in
10 bad faith or for the purpose to unduly delay this case. Additionally, extending
11 the previously scheduled deposition to April 21, 2006 would not prejudice
12 Plaintiff and would speed overall efforts to bring discovery, and this matter in
13 whole, to a timely conclusion.
