This case is currently set for a Pretrial Conference on October 31, 2005, which is in conflict with a unique family vacation previously scheduled for the undersigned, who is set to try this case. Tickets have been purchased; hotel accommodations have been pre-paid, and an unfortunate end to a long planned family vacation would occur if undersigned would be required to attend the October 31, 2005, Pretrial Conference. Therefore, undersigned counsel respectfully

requests a new Pretrial Conference date to be set in this matter.

In addition, the undersigned is scheduled to begin trial on December 19, 2005 before the Honorable Robert Houser in Cause No. CV2004-008055, captioned Central Trucking v. McKelvey Trucking. Trial in that matter is scheduled to last 4 days.
