Pursuant to defendants' Request for Orders (Doc. 174), and the Court's

conclusion, after oral argument on August, 21, 2006, that good cause existed to reopen

discovery and permit DNA testing; IT IS ORDERED that Maricopa County's Office of the Medical Examiner is directed to release tissue samples in Case Numbers 03-01653 and 03-01652 to a DNA testing facility to be named by Defendants. IT IS FURTHER ORDERED that Defendants are to be held responsible for any costs associated with the DNA testing. DATED this 6th day of September, 2006.
