REQUEST FOR ORDERS

Defendants, by and through undersigned counsel, hereby request that the court issue Orders directing the Maricopa County Office of the Medical Examiner to release tissue samples in case number 03-01652 and case number 03-01653 for DNA testing and comparison. On July 17, 2006, defendants filed a motion with the court to reopen discovery for

the purpose of conducting DNA testing. Following response and reply, the court held

Oral Argument on August 21, 2006. The court concluded that there was good cause to reopen discovery and granted the motion to permit DNA testing. Furthermore, the court ordered defendants to pay for the testing.

The Maricopa County Office of the Medical Examiner does not conduct DNA testing itself. Furthermore, the Office of the Medical Examiner will not release tissue samples to a private lab until it receives a Court Order directing the office to do so. WHEREFORE, defendants request that the court sign the attached Orders directing the Maricopa County Office of the Medical Examiner to release tissue samples

to a DNA testing facility to be named by the defendants in order to conduct DNA testing and comparison with the plaintiff's samples, so that defendants can provide these orders to the Maricopa County Office of the Medical Examiner.
