The current status of the case is that on August 30, 2005, defendant Maxwell Productions, LLC ("Maxwell") filed for bankruptcy (Case No. 05-16179-RJH (Bankr. D. Ariz.)), automatically staying the plaintiffs' claims against it under 11 U.S.C. § 362. Currently, Philips is continuing to attempt to locate and serve defendant Nasser Farrokh. Given the automatic stay of plaintiffs' claims against Maxwell, and plaintiffs' presently unsuccessful attempt to serve defendant Farrokh, plaintiffs request that the Court postpone indefinitely the Pretrial Conference that is presently scheduled in this matter for October 3, 2005. A proposed form of Order is being lodged herewith.
