The Court has granted Plaintiff, who is pro se, three extensions of time to file a Response. [Dkts. 41, 45, 48]. Plaintiff had not responded to the Motion for Summary Judgment. This Court ordered a status hearing on September 9, 2005. [Dkt. 49]. Plaintiff did not attend that hearing. Accordingly, IT IS ORDERED setting a hearing on September 26, 2005 at 10:45 a.m., for Plaintiff to appear and show cause why the case should not be dismissed without prejudice for failure to prosecute, to be vacated upon the filing of Plaintiff's response to the Motion for Summary Judgment. IT IS FURTHER ORDERED that Plaintiff may appear telephonically by calling Chambers five minutes prior to the hearing at: 602-322-7530.
