The parties, by and through undersigned counsel, hereby stipulate to
22
23 continue the Status Hearing currently set for November 8, 2005 at 4:00 P.l\/I. The
24 continuance is requested because the parties have entered into a settlement
25 agreement resolving this matter. However, due to the pending Chapter 11
26 proceedings of the Lees Children L.L.C. and the Chapter 7 proceedings for
27 Nicholas Lees, both parties have to obtain Bankruptcy Court approval before the
case can be dismissed. The parties filed motions in the Bankruptcy Court

I requesting approval of the settlement in each of their respective cases.

3 Objections were tiled and a hearing held on the objections on October 20, 2005.
4 The Bankruptcy Judge has approved the settlement, subject to notice to the
5 creditors. After notice is provided and upon receipt of the signed Orders in each
6 bankruptcy GBSG, the parties will submit a stipulation to dismiss this action.
1 Accordingly, the parties request that the status hearing should be rescheduled in
8 60 days to allow ample time for notice to be provided and obtain the signed orders
O 9 from the Bankruptcy Court and the Hling of the stipulation to dismiss this action.
