In the absence of a response by Plaintiff to Defendant's Motion for Summary

Judgment (Doc. #33), it appears that Defendant's Motion for Summary Judgment is

ready for the Court's consideration. As a result, Defendant's subsequent Motion for
17

Summary Dismissal (Doc. #38) will also be ready for the Court's consideration providing
18

that the Court does not receive a response by October 21, 2005. Therefore,
19

IT IS ORDERED withdrawing the reference of this case to the magistrate judge
20

as to Defendant's Motion for Summary Judgment (Doc. #33) and Motion to Dismiss
21

Case (Doc. #38) All other matters shall remain with Magistrate Judge Sitver for
22

disposition as appropriate.
