Pursuant to Local Rule of Civil Procedure 40.2(d), Plaintiff Kaye Hutton, on behalf of herself and all opt-ins, and Defendant Bank of America, N.A., hereby inform the Court and Clerk that they have reached a settlement of this lawsuit. In accordance with the terms of the settlement, the Parties will file, within five business days, a Joint Motion Requesting Preliminary Approval of the Proposed Collective Settlement Agreement and Requesting a Hearing Regarding Final Approval. The Parties also request that the Court stay the matters that are the subject of the Court's Orders dated April 26, 2007 (docket 325), and April 27, 2007 (docket 326). The Orders require Plaintiff to file a response to Defendant's Motion for Reconsideration, and Defendant to resubmit a statement regarding Barbara Davis' notes, by Thursday, May 10, 2007, and require the parties to submit a joint statement of the case and juror questionnaires by May 16, 2007.
