Notice is hereby given that Bank of America, N.A., Defendant in the abovenamed case, hereby appeals to the United States Court of Appeals for the Ninth Circuit from the district court's Orders dated September 14, 2006 (civil docket No. 303), and November 2, 2006 (civil docket no. 312), ruling that the notes of Barbara Davis, Esq., were the work product of Ms. Davis, but a substantial need exists to have them produced and therefore, defense counsel was to submit in camera a statement designating which portions of Ms. Davis' notes are ordinary work product, and which portions are opinion work product, and denying Defendant's motion to reconsider the finding of substantial need and the directive that defense counsel designate the work product character of the notes.
