Edwards and Sons, Inc., 444 F. Supp. 2d 1100 (S.D. CA August 2006) supports Plaintiff's Response to Defendant's Motion for Summary Judgment as follows: 1. Section III (A) Client Managers Were Not Paid a Salary Basis ­ Therefore Client Managers Cannot be Exempt;

2. Section III (B) The Client Manager's Primary Duty Was Sales ­ Therefore Client Managers Cannot be Exempt; 3. Section III (C) Client Managers Did Not Regularly Exercise Discretion & Independent Judgment; 4. Section III (D) In any event, there is a Genuine Issue of Material Fact as to Whether Client Managers Were Paid on a Salary Basis, Whether The Client Manager's Primary Duty Was Sales, and Whether the Client Manager Regularly Exercised Discretion & Independent Judgment 5. Section VIII Summary Judgment is Not Appropriate on the State Law Treble Damages Claim; 6. Section VIII(A) Plaintiff's State Law Claims are Not Preempted by the FLSA; 7.
