Plaintiff hereby submits his proposed Jury Verdict Form for the total amount of award. Because certain elements of damage may be duplicated between claims while others are not, the general verdict forms for each claim could give rise to confusion and error in either under or over calculating the total damages the jury intends to award Shaffer. Failure to include a total could result in a double award of damages if the jury finds that the damage from one claim is identical to the damage from another. However, if the jury finds, for example, that the reputation damage from being accused of a felony is different from the reputation damage from being terminated, Shaffer would be entitled to both amounts. The only way to know and avoid a mistake is for the jury to communicate what its intentions were for the total award. This verdict form should be supported by an instruction to the jury regarding the law against multiple recoveries for the same damage.
