IT IS ORDERED affirming the Firm Trial date of 9/13/2005. Estimated length of trial: 5 days commencing at 1:30 p.m. on day 1 and thereafter at 9:00 a.m. on 9/14; 9/15; 9/20; 9/21 and 9/22. The jury will consist of 8 with 3 strikes for the Plaintiff and 3 strikes for defendant. A panel of 30 jurors is ordered this date. Plaintiff's Motion in Limine [doc 83] is argued to the Court as stated on the record. At the request of the defendant, Counsel shall file simultaneous briefs, addressed to the legal issues arising out of this policy making argument that the doctrine does not apply to whistle blowing speech no later than 9/7/2005. Counsel shall submit an electronic copy directly to chambers' mailbox at: [email protected]. Counsel shall submit their List of Witnesses, Proposed Voir Dire, Proposed Jury Instructions and Stipulated Form of Verdict by 9/9/2005.
