Under consideration is Plaintiff's Motion for Enlargement of Time, dated December 27, 2005 and filed December 30, 2005 (#109). Plaintiff seeks an extension of the December 23, 2005 deadline for filing his motion to compel, citing delays in obtaining discovery responses from Defendants following the grant of their extension request, and holiday delays in obtaining copying and mail services. Simultaneously, Plaintiff filed his motion to compel (#108). Defendants have not responded to the motion to extend, but have responded to the motion to compel. The Court finds excusable neglect for the delay. IT IS THEREFORE ORDERED that Plaintiff's Motion for Enlargement of Time, filed December 30, 2005 (#109) is GRANTED. Plaintiff's Motion to Compel and Motion for Sanctions, filed December 30, 2005 (#108) shall be deemed timely filed.
