Plaintiff, LAWRENCE J. WARFIELD, as the Receiver appointed by the United 14 States District Court for the District of Arizona in SEC v. Dillie, et al., respectfully 15 requests that this Court dismiss Defendants Heritage Marketing and Insurance Services, 16 Ronald Kerher, and Paul Pichie from the above-captioned matter for the reason that the 17 parties have agreed to a settlement of all claims against these Defendants. The terms of 18 the settlement between Plaintiff and the above-named Defendants have been approved by 19 the Receivership Court pursuant to Order No. Petition No. 100 (Docket No. 569) and 20 Order Re: Petition No. 104 (Docket No. 573) entered on August 25, 2006 in SEC v. 21 Dillie, et al, Cause No. 2:01-cv-2493. 22 23
