Plaintiff Lawrence J . Warfield and Defendant Eugene Jones hereby stipulate and

agree to the following terms of settlement and stipulated judgment against Defendant
15
Eugene Jones.

1. In full settlement of any and all claims of the Plaintiff in the above-
17
referenced matter and without admitting any truth or validity to those claims, Defendant
18
Eugene Jones agrees to pay to the Plaintiff the sum of $22,500.00. The amount of
19
$22,000.00 shall be payable in eighteen (18) consecutive monthly installments of
20
$1,250.00 to the Plaintiff commencing on April 30, 2005 and payable on the last day of
21
each consecutive month until paid in full.

1 2. lt is f`urther stipulated and agreed that Plaintiff shall have judgment against
2 Defendant Eugene Jones in the amount of $37,500.00, less any payments Defendant has
3 made, should Defendant Eugene Jones fail to make after forty—five (45) days from the
4 date of default of the proper monthly payment.
5 3. Receiver Lawrence Warfield agrees to not execute upon this Stipulated
6 Judgment unless Defendant Jones has been notified of his default by certified mail.
7 4, Once complete payment has been made under the terms of the Settlement
8 Agreement, the stipulated judgment is null and void.
