l Defendant/Counterclaimant, Nathan A. Roesing, attempted to contact counsel for
2 Best Westem for the first time since June 24, 2005, the date of the pretrial conference in
3 this matter, on August 22, 2005. Mr. Roesing left a voice mail message indicating that the
4 cell phone number for Defendant/Counterclaimant Ohio Key I Corp. was the number to
5 use to contact him. Counsel for BWI has attempted to contact Mr. Roesing at that
6 number, without success.
7 To date, there have been no offers of settlement or any other communication Hom
8 Mr. Roesing indicating his ability or willingness to settle this matter.
9 Furthermore, counsel for BWI has not been made aware that Roesing has made any
10 effort to or has been successful at retaining counsel in this matter.
